1.1 Our terms and conditions set out the rules which are applicable for you to participate in the 66299 prize competition. You should ensure that you have read these terms and conditions and fully understand their meaning as your participation in the 66299 prize competition constitutes your full acceptance of these terms and conditions.

2 Terms

2.1 Competition means the 66299 reverse auction prize competition.

2.2 Bid means your text message and your bid amount in pence, which is aimed at having the lowest unique bid to obtain a specified Prize that has been offered online by 66299.

2.3 Participant, Player means the individual or person who participates in the 66200 Competition by placing a Bid by text.

2.4 Prize means any product or combination of products offered by 66299.

2.5 Lowest Unique Bid means the lowest whole number (in pence) Bid for a Prize and which is closest to one penny (1p), that has not been selected by any other Player. Zero (0) or negative (-) amounts are not allowed (Note you will still have been charged by your service provider).

2.6 Player means an individual who participates in the Competition by placing Bids using SMS

2.7 ”Our”, “We” or “Us” means 66299 a trading style, name of Shebang Distribution Limited, a company registered in England and Wales (Company Number4372471). Whose registered office is at 2 Lamport Court, Heartlands Business Park, Daventry Northamptonshire, NN11 8UF

2.8 Winner means the Player who has the Lowest Unique Bid in pence at the close of the Competition.

3 The offer

3.1 The offer is for a Prize to be won by way of a reverse auction prize competition (the “Offer”) subject to the following terms & conditions:

3.2 The prize can only be offered to one successful player per prize auction.

3.3 The prize shall be awarded to the one player who has the lowest unique bid in pence

4 Auction period

4.1 Each prize offered shall remain open until the period published has expired.

4.2 Each auction period can be seen at www.66299.co.uk, the auction history and previous winners is also available.

5 The prize

5.1 Unless otherwise stated within the Prize description, no Prize shall include reimbursement of any travel and other expenses incurred by the Winner in connection with the receipt of the Prize.

5.2. All prizes where applicable come with a 12 month manufacturer’s warranty. This warranty does not affect your statutory rights which cannot be excluded or restricted at law.

6. Delivery

6.1 All prizes will be delivered within 14 days of the auction closing

6.2 Parcels sent to even the most remote parts of the United Kingdom, such as Northern Scotland and parts of Northern Ireland and the Isle of Man etc. may take longer to deliver.

6.3 These items are sent by Royal Mail Silver Service, Parcel Force or City Link Insured Next Day Delivery. Saturday and Monday delivery cannot be guaranteed by Royal Mail and Parcel Force and City Link do not deliver on a Saturday.

7. Returning Products

7.1. If for any reason you wish to return a product or receive a replacement product please call our Customer Service Team for assistance. (See contact us)

7.2. We would request that you contact our Customer Service Team as soon as any problem becomes apparent.

7.3. We will deal with all replacements with high priority.

7.4. Replacements will be sent out when the original item is returned.

7.5. It is the customer’s responsibility for the safe return of all goods. All items must be returned within “a reasonable time” as they were received with their original packaging and full contents included, along with original documentation. Items returned in a less than pristine condition and/or with damaged or missing packaging will incur charges to cover the cost of the items. These charges will be pursued by 66299.co.uk.

7.6. Where goods become faulty within the first 28 days and qualify for an exchange, the faulty items must be returned to us, with the original packaging, within 28 days of the date of delivery. Items returned as faulty and subsequently found to be subject to customer damage will incur charges. These charges will be pursued by 66299.co.uk.

7.6. Please note that Prize images are for illustration purposes only and colour may vary (e.g Sony PSP either black or white)

7.7. All prizes are offered subject to their availability at time of publication; in the event of a prize being unavailable we reserve the right to substitute for an equivalent or better. (For example a HP Laptop may be replaced by an equivalent product made by Sony).

7.8. All free gifts are supplied with a manufactures warranty; it is the customer’s responsibility to register the warranty with the relevant manufacturer.

7.9. Please termsrm us if you have not received your prize within 14 days of the end of the published auction and you are the winner.

8. Acceptance

8.1 Bids can only be made in pence and cost £1.50 per Bid (UK). You must ensure you have the bill payer’s permission before entering 66299.

8.2 An Offer by Us shall be deemed accepted on receipt by Us of the text message, Any text messages, received by 66299 after the Bidding Period, will not count and are non refundable.

8.3 The Lowest Unique Bid shall be determined by 66299 after the expiry of the Bidding Period.

8.4 We require confirmation of the identity of the Player who is the Lowest Unique Bidder; the winner shall be communicated to by text or by phone, whatever method is deemed appropriate.

8.5 On the acceptance of the Offer from the Player who texts, the Lowest Unique Bid at the close of the Bidding Period (“the Winner”), has entered into a binding legal contract for the award of the Prize by Us and the Winner assumes full responsibility for the Prize.

8.6 In the event that we deem in our discretion the Winner to have secured the Lowest Unique Bid by way of machine, or by way of participation in conjunction with a syndicate or group bidding process which is unfair to the Competition, the Winner’s Bids will be declared void. Such Bids are non-refundable by 66299.

9 Payment of your bid

9.1 66299 accepts all major credit and debit cards as a form of payment, however if the cost of receiving the payment is more than the payment value we may agree at our discretion not to collect this payment.

9.2 A delivery charge of £9.99 will be added to your invoice per auction.

10 Disclaimer and limitation of our liability to you

10.1 Nothing in this Agreement will be construed as excluding or restricting (whether directly or indirectly) Our liability for death or personal injury caused by Our negligence or for fraudulent misrepresentation. Subject to the foregoing, Our liability to You shall be limited to the value of the Lowest Unique Bid whether caused by breach of contract or tort, including negligence or otherwise. For the avoidance of doubt, entries that are incomplete will be deemed invalid. We accept no responsibility for entries lost, delayed or incomplete in transmission.

10.2 In any event, We will not be liable for any damages or losses whether direct or indirect that you may suffer as a result of failure by us to recognise, process or accept your Bid including, but not limited to access delays or interruptions, data non-delivery or mis-delivery, any acts of God, war or terrorism, breaches of security or unauthorised use of your mobile telephone or personal data arising from hacking and /or failure or lack of reception of telephone or mobile telephone networks.

10.3 To the maximum extent permitted by law, all warranties and representations of any kind in relation to the accuracy of the description, or estimated value of the Prize shall be excluded. We undertake no obligation to investigate or carry out any test in sufficient depth on each Prize to verify the accuracy or otherwise of the description given and you should not place any reliance on such descriptions or assume that such investigations have taken place. Accordingly we will not be liable for any misstatement, error or omission from the description of any Prize.

11 Refusals or Termination

11.1 We reserve the right to refuse any application to open and or to suspend and or terminate any mobile phone bidding facility.

11.2 At any time and at our sole discretion without providing reasons for our decision.

11.3 In the event that it is found that any information you have provided to 66299 is untrue, inaccurate, incomplete, out of date or otherwise misleading.

11.4 In the event that you fail to provide 66299 with any information which we may reasonably request in order to verify any details which you may have provided to 66299.

11.5 In the event that there is a breach by you of Our Terms and Conditions or otherwise use the 66299 auction in an unauthorised manner.

12 Players Obligations

12.1 When requested to do so in order for 66299 to process your winning bid it is the players obligation to contact 66299 by e-mail, telephone or in writing to 66299 at 2 Lamport Court, Heartlands Business Park, Daventry Northamptonshire, NN11 8UF

12.2 Winning bids can only be claimed by the mobile phone owner, proof of ownership will be asked for at point of claim

12.3 The competition is solely provided by 66299 for personal use only, any commercial exploitation unless with prior permission of 66299 or Shebang Distribution Limited will mean your exclusion from this and any auctions provided by 66299.

12.4 You must not attempt interfere with the 66299 website, this includes to copy or try and use and content displayed.

12.5 66299 will not supply any prize or winnings to any player if you have breached our terms and conditions.

13. Severability

13.1 If it is found by rule, law, regulation of a government, or by a final determination of a court of a competent jurisdiction such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

20.4 In the event that the Winner does not meet the 66299 entry requirements under these Terms and Conditions, the Winner’s Bid will be deemed invalid and the Prize shall be awarded to the Player with the next valid unique bid in pence (p) at Our discretion in accordance with these terms.

21.1 By playing the 66299 reverse auction competitions you will receive a number of messages which include tip status alerts and other promotional offers.

21.2 By playing you are opting in to receive future promotional messages from 66299 about any other competitions and other games which we or our chosen partners run from time to time.

21.3 Promotional messages from 66299 or our chosen partners are free. However free only relates to text messages that we send to you, free in no way refers to any text that you send to 66299 or our chosen partners

21.4 You can at any time be removed from the 66299 reverse auction or other games database, please text STOP to 66299, this message will cost £1.50 however if you send a email to privacy@66299.co.uk with the number that you wish to have removed we will remove your number with 48 hours of receipt of your email.
